A common misconception is that bankruptcy is no longer an option for individuals with debt problems. This is not true. While bankruptcy is a little more complicated under the new law that was passed in 2005, in most cases it can still be easily done by an attorney who understands the law.

Collection agencies and creditors will often call debtors on the phone and claim that debts such as payday loans and credit card bills are no longer dischargeable in bankruptcy. Those are just flat-out lies. If you have serious debts, it is in your best interests to consult an attorney to learn more about your rights.

Some people are hesitant to file bankruptcy because they feel that doing so will label them as deadbeats. That is another myth that the credit card companies would like you to believe. The primary reason people file bankruptcy is because of circumstances beyond their control, such as job loss, divorce, or significant medical expenses that are not fully covered by insurance. Bankruptcy laws are there to provide you a fresh financial start when you need it.

Types of bankruptcy

There are three main types of bankruptcy protection:

  • Chapter 7 bankruptcy is for individuals or businesses. This is the simplest and easiest kind of bankruptcy and is sometimes known as "liquidation" bankruptcy.
  • Chapter 13 bankruptcy is for individuals only. This is a reorganization type of bankruptcy that is typically used if you are behind on your house or car payments. Filing Chapter 13 bankruptcy can allow you to avoid foreclosure or repossession and catch up the arrearage over a period of time. Under new bankruptcy laws, some people may be required to file Chapter 13 bankruptcy rather than Chapter 7 bankruptcy due to their income or assets.
  • Chapter 11 bankruptcy is a business reorganization. Typically, Chapter 11 bankruptcy is used when the business wants to continue but needs a little breathing room and protection from creditors.
